MJ Manzini Holdings (Pty) Ltd
Terms of Service & Conditions of Carriage
1. Who these terms apply to
These terms govern the carriage of goods by MJ Manzini Holdings (Pty) Ltd (registration number 2026/429112/07), trading as MJ Manzini Logistics, and apply to every consignment we accept unless we have signed a separate written contract with you that says otherwise.
2. Quotations and estimates
Prices produced by the instant estimator on this website are estimates, calculated from the route, load size and service level you enter. They are not offers and are not binding. A binding price is only the one we confirm in writing for your specific consignment.
[TO CONFIRM — how long a confirmed quotation stays valid, and what triggers re-quoting (waiting time, failed collection, re-delivery, changes in load or address).]
3. Delivery timeframes
Transit times and any on-time performance figures shown on this website are indicative targets based on past performance. They are not guarantees, and are subject to matters outside our control including weather, road closures, breakdowns, congestion, industrial action and load shedding.
[TO CONFIRM — whether any service level is offered as a guarantee, and what remedy applies if it is missed. Note the website currently advertises a specific on-time percentage; that figure should either be substantiated or qualified here.]
4. What we will not carry
[TO CONFIRM — the prohibited and restricted goods list. Typically covers cash and negotiable instruments, precious metals and stones, live animals, human remains, firearms and ammunition, dangerous goods outside our licensing, perishables, and illegal items.]
5. Packaging and the sender's responsibilities
You are responsible for packaging goods so they withstand normal handling in road freight, for describing them accurately, for declaring anything hazardous, and for ensuring the person at the delivery address is able to receive them.
6. Proof of delivery
We record delivery by capturing the name of the person who receives the consignment, together with the date and time. That record is our proof that delivery took place.
7. Liability
[TO CONFIRM — this is the section that matters most, and it is intentionally left blank.] It must state the limit of our liability for loss, damage or delay, whether that limit is per consignment or per kilogram, what is excluded (including consequential loss), and how it interacts with any cargo insurance carried. Do not fill this in without advice.
8. Insurance
[TO CONFIRM — whether goods-in-transit cover is included by default or must be arranged separately, the sum insured, and what the customer must do to claim under it.]
9. Claims
[TO CONFIRM — the claims procedure and time bars: how long a customer has to notify visible damage, concealed damage, and non-delivery, where to send a claim, and what documentation is required.]
10. Payment
[TO CONFIRM — payment terms, accepted methods, interest on overdue accounts, and lien over goods.]
11. Consumer rights
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be limited. Where a term conflicts with that Act, the Act prevails.
12. Governing law
These terms are governed by the laws of the Republic of South Africa.
